Swimming Pool Safety Act 2004 all swimming pools and spas on residential properties less than 1.8 hectares must have approved barriers before the property is sold or there is a change of tenancy.
What do I have to do under the new Swimming Pool Safety Act?
If the property is to be sold, transferred or rented a pool owner must ensure that their pool has an Acknowledgement Notice or a Compliance Certificate.
What is the difference between an Acknowledgement Notice and a Compliance Certificate?
An Acknowledgement Notice is issued upon a self-declaration from the pool owner that their pool barrier meets the Community Safety Standard. The Community Safety Standard has been developed in response to the specific needs of Territory pool owners and provides a greater degree of flexibility. A pool owner wishing to self-declare may request the free advice of a Pool Safety Adviser without obligation to perform works.
A Compliance Certificate is issued after the Water Safety Branch is satisfied that the pool barrier meets either the modified Australian Standard or the Non-standard Safety Provision. A Pool Safety Adviser will assess the pool and the Water Safety Branch will certify that it meets the modified Australian Standard or the Non-standard Safety Provision.
What do I need to know about the Community Safety Standard?
The Community Safety Standard requires a pool owner to self declare that their pool or spa is enclosed by a barrier that will effectively prevent a child under five years of age from obtaining unsupervised access. The minimum safety guidelines, free advice and a declaration form are available from the Water Safety Branch.
What do I need to know about the modified Australian Standard?
Owners of pre-existing pools may choose to upgrade to the modified Australian Standard. Under the modified Australian Standard a Pool Safety Adviser will need to inspect the swimming pool or spa before the Water Safety Branch can issues a Compliance Certificate.
