Swimming Pool Safety Act 2004

Pool fencing laws which achieve practical and common sense outcomes took effect from 15 March 2004. The Swimming Pool Safety Act 2004 applies to residential properties smaller than 1.8 hectares with a swimming pool or spa.

Child safety remains at the heart of the pool safety laws. The Community Safety Standard and the Modified Australian Standard are based on the same intention of preventing young children from obtaining access to a pool or spa area. To comply with safe pool standards, pools and spas must be enclosed by a barrier that will effectively prevent a child under five years of age from obtaining unsupervised access.

Existing pool owners (owners of pools or spas installed before 1 January 2003) can choose between:

  • The Modified Australian Standard (MAS); or
  • The Community Safety Standard (CSS) - a simple self declaration process.

Both are supported by a free advisory service and a grant scheme.

New pool owners (owners of pools or spas installed after 1 January 2003) are required to meet the Modified Australian Standard.

There is overwhelming community support for increased safety for children in an around water. Public knowledge of pool safety is being improved through a community education and awareness program. Owners of pools or spas are encouraged to keep their backyards safe and take advantage of the free Water Safety Awareness Program for children under 5 years of age.
